SKATE CANADA/SKATE ONTARIO POLICIES FOLLOWED BY FHFS

DISCIPLINARY POLICY

Purpose

The purpose of this Disciplinary Policy is to establish a fair, consistent, and transparent process for addressing conduct that is inconsistent with the standards, policies, and values of the Forest Hill Figure Skating Club ("FHFSC" or the "Club").

This policy applies, without exception, to all Board Members, Club employees, Coaches, Program Assistants, Skaters, Parents/Guardians, Volunteers, Members, and any individual participating in or representing FHFSC.

Application

This policy applies whenever an individual associated with FHFSC violates:

  • FHFSC By-Laws;

  • FHFSC Policies and Procedures;

  • FHFSC Code of Conduct;

  • FHFSC Rules;

  • Coaching contracts or employment agreements;

  • Skate Canada Rules, Regulations, Code of Ethics, Safe Sport policies, or other applicable policies;

  • Any other standards adopted by the Club from time to time (collectively referred to as the "Club Rules").

By registering as a member, accepting employment, coaching, volunteering, or otherwise participating in Club activities, individuals acknowledge that they have reviewed (or have had the opportunity to review) the Club Rules and agree to abide by them.

Disciplinary Committee

The FHFSC Disciplinary Committee shall consist of:

  • President (Chair)

  • Secretary

  • Director-at-large

The President serves as Chair of the Committee and will only vote in the event of a tie.

Should any member of the Disciplinary Committee have a conflict of interest regarding a complaint—including being directly involved in the incident or having a close personal and/or business relationship with any individual involved—that member shall recuse themselves from the matter. The remaining Committee members shall appoint another Board Member to participate for that investigation.

The Committee shall:

  • review all reported incidents promptly;

  • gather relevant information;

  • determine whether a breach of Club Rules has occurred;

  • determine appropriate disciplinary action where required;

  • maintain confidential records of all complaints and decisions; and

  • provide the Board of Directors with non-identifying summaries of disciplinary matters as appropriate.

Whenever practical, the Committee will review reported incidents within five (5) business days of receiving the complaint and communicate its decision to the involved parties as soon as reasonably possible.

The Committee's decisions are final unless otherwise required by applicable law or Skate Canada procedures.

Reporting Concerns

Any Board Member, Coach, Program Assistant, Club employee, volunteer, parent, or member who witnesses or becomes aware of conduct that may violate the Club Rules is encouraged to report the matter promptly.

Reports may be submitted verbally or in writing to any member of the Disciplinary Committee and should include, where possible:

  • date and time of the incident;

  • location;

  • individuals involved;

  • witnesses;

  • description of the incident; and

  • any immediate action taken.

Whenever possible, incidents should be reported within 24 hours.

Immediate Safety Measures

Any Coach, Program Director, Club employee, or member of the Disciplinary Committee has the authority, acting reasonably and in accordance with Club policies, to remove a skater or other individual from an ice session, program, meeting, or Club activity when their behaviour:

  • creates an unsafe environment;

  • disrupts Club programming;

  • violates Club Rules; or

  • poses a risk to others.

Such action is temporary pending review by the Disciplinary Committee and must be reported as soon as reasonably possible.

Communication During an Investigation

Once a complaint has been reported, all parties are expected to allow the disciplinary process to proceed without interference.

To protect all individuals involved:

  • communications regarding the complaint should occur through the Disciplinary Committee whenever possible;

  • discussions involving a minor shall include a parent or guardian unless otherwise directed under Skate Canada Safe Sport procedures; and

  • confidentiality shall be maintained by all participants to the greatest extent possible.

Progressive Discipline

The Club recognizes that not all situations require the same response. The Disciplinary Committee may consider:

  • severity of the conduct;

  • safety implications;

  • previous disciplinary history;

  • whether the conduct was intentional;

  • willingness to cooperate and correct behaviour; and

  • any other relevant circumstances.

Depending on these factors, discipline may follow the progressive steps below or may proceed directly to more serious consequences where warranted.

First Offence

The individual may receive:

  • a verbal warning;

  • education or coaching regarding expectations; and

  • documentation of the incident maintained by the Club.

The incident record shall include:

  • date;

  • description;

  • individuals involved;

  • witnesses (if any); and

  • actions taken.

Second Offence

The individual may receive:

  • a written warning;

  • a meeting with the Disciplinary Committee; and

  • any additional corrective measures considered appropriate.

The Committee shall review the matter as soon as reasonably practicable after the complaint is received, allowing sufficient time for the Committee to gather relevant information and make an informed decision.

Possible consequences may include:

  • probation;

  • temporary suspension from Club activities;

  • restrictions on participation;

  • additional education or training;

  • removal from volunteer responsibilities; or

  • other appropriate disciplinary measures.

Third Offence

Where repeated misconduct continues despite previous disciplinary action, the Club may impose more significant consequences, including:

Skaters and Parents/Guardians

  • suspension or termination of Club membership;

  • removal from Club programs;

  • loss of future registration privileges; and

  • forfeiture of registration fees where permitted by Club policy.

Coaches

  • suspension;

  • termination of coaching privileges;

  • termination of contract in accordance with its terms; and/or

  • notification to Skate Canada where appropriate.

Board Members, Employees, Volunteers or Program Assistants

  • suspension of duties;

  • removal from committees;

  • request for resignation;

  • termination of employment or volunteer role where applicable; or

  • any other action authorized by the Board.

Serious Misconduct

Certain incidents are sufficiently serious that progressive discipline may not be appropriate.

Examples include, but are not limited to:

  • harassment;

  • bullying;

  • discrimination;

  • abuse or maltreatment;

  • retaliation;

  • threats or violence;

  • serious breaches of Safe Sport;

  • conduct that jeopardizes the safety or wellbeing of participants;

  • significant breaches of coaching contracts or employment agreements;

  • financial misconduct; or

  • behaviour that may bring the Club or Skate Canada into disrepute.

In these situations, the Club may immediately:

  • suspend participation pending investigation;

  • refer the matter to Skate Canada Safe Sport;

  • notify appropriate governing bodies;

  • report to law enforcement or child protection authorities where legally required; and/or

  • terminate membership, employment, volunteer status, or coaching privileges without following the progressive discipline steps outlined above.

Where a matter falls under Skate Canada Safe Sport, Skate Canada's policies and procedures shall take precedence over this policy.

Record Retention

The Disciplinary Committee shall maintain confidential records of all reported incidents, investigations, decisions, and disciplinary actions in accordance with applicable privacy legislation and the Club's record retention practices.

Records may be retained for as long as reasonably necessary to protect the interests of the Club and its participants.

Confidentiality

All disciplinary matters shall be handled with discretion. Information will only be shared with individuals who require it to properly investigate, administer, or resolve the matter, or where disclosure is required by law or Skate Canada.

This policy will be valid to Aug 31, 2027
